Terms of Use

1. Status and acceptance

These Terms govern the MileMouse website and MileMouse software. Access to the website is subject to these Terms. By installing or using MileMouse software, you agree to these Terms, subject to non-waivable rights under applicable law. If you do not agree, do not install or use the software.

2. Purpose and system access

MileMouse is a personal input-activity utility for Windows. It runs as a full-trust tray app and uses system-wide global input hooks while other apps are focused so it can count activity totals.

MileMouse counts only aggregate activity totals. You can pause tracking or quit the app at any time. Depending on your environment, security tools may flag global hooks and related permissions.

Start at login is optional and user-controlled. If enabled, MileMouse asks Windows to launch the app when you sign in; you can disable it in MileMouse or Windows settings.

3. Eligibility and lawful use

You may use MileMouse only on devices or accounts that you own, control, or are authorized to use.

• Do not use MileMouse for covert surveillance or hidden monitoring of another person.
• Obtain any required consent and follow local law, workplace rules, and policy requirements.
• MileMouse is not a safety, medical, timekeeping, payroll, or employee-performance system.

4. License

Subject to these terms and applicable Microsoft Store terms, Magellan Software LLC grants a limited, personal, non-exclusive, non-transferable, revocable license to use the app.

MileMouse is proprietary software. Except where applicable law permits, you may not resell, redistribute, reverse engineer, or evade feature gates. Third-party open-source components remain under their own licenses, with notices provided in the app.

5. Free, Pro, and purchases

Current Free behavior shows today metrics and the newest seven history rows while older local history remains stored. Pro is an optional one-time Microsoft Store purchase that unlocks current Pro features, including unlimited history, records and charts, break tools, and share/export/backup actions.

MileMouse includes an automatic local 30-day Pro preview that starts only after a definitive Microsoft Store Free entitlement result. The preview window is 30 consecutive 24-hour periods measured locally.

The local trial may restart if app data is removed or the app is reinstalled. No payment is required to run the trial and there is no automatic charge.

At trial expiry, MileMouse returns to permanent Free. Existing activity history remains saved locally, but Pro-only views and controls lock until Microsoft Store Pro is active.

Microsoft Store shows the final price at checkout, and pricing may vary by market, tax, and applicable regional rules. Microsoft Store services handle billing, tax, refunds, account services, and entitlement processing under Microsoft terms.

Mandatory Store and consumer rights remain in force. Feature entitlement may depend on Microsoft Store availability and license checks.

6. Data and user responsibilities

The Privacy Policy is incorporated into these terms by reference. You are responsible for your device access, local files, and backups.

• Exports and backups are user-directed.
• Restore replaces activity totals after confirmation.
• Calibration and resulting measurements are estimates based on local setup.
• Protect your Windows account, device, and local backup locations.

7. Acceptable use

You may not use MileMouse to:

• Perform unlawful, harmful, or covert tracking activity.
• Bypass licensing checks or feature gates in unauthorized ways.
• Interfere with app operation, distribute malware, or attack the software supply chain.
• Redistribute proprietary MileMouse binaries outside allowed channels.

8. Updates, features, and availability

Features and services may evolve. After purchase availability, changes affecting paid functionality will follow applicable law, platform terms, and non-waivable consumer rights.

MileMouse may provide updates for security, reliability, or compatibility. Uninterrupted service or compatibility with every environment is not guaranteed.

9. Accuracy and non-professional advice

Distance totals depend on DPI assumptions and calibration. Input totals and active-time calculations are usage estimates.

MileMouse is not medical, ergonomic, legal, employment, payroll, or emergency-service advice.

10. Third-party services and components

Microsoft Store services are governed by Microsoft terms and privacy policies:

MileMouse includes third-party open-source components under their own licenses; related notices are preserved in the app.

11. Warranty

To the maximum extent allowed by law, MileMouse is provided on an "as available" and "as is" basis, without guarantees that it will be uninterrupted, error-free, or fit for every purpose.

Nothing in these terms removes any statutory or other non-waivable warranties that apply under law.

12. Liability

To the maximum extent permitted by law, MileMouse is not liable for indirect, consequential, special, punitive, or exemplary damages, or for lost data, profits, or business interruption arising from use of the app.

This limitation does not exclude liability that cannot be excluded by law, including non-excludable consumer rights and, where prohibited by law, liability for fraud, gross negligence, or personal injury.

13. Termination

You may stop using MileMouse at any time by quitting or uninstalling it. Subject to applicable law, your license may end for material breach of these terms.

Provisions that by nature should survive termination continue to apply. Deletion of local files and deletion of user exports or backups are separate user actions.

14. Changes to these terms

We may update these terms. The Last updated date will change. Changes are effective when posted or on a later stated date.

Where law requires notice, consent, or a separate acceptance step for material changes, those steps will be provided.

15. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws principles.

Disputes may be brought in a state or federal court of competent jurisdiction located in Georgia, unless applicable law gives you the right to use another forum.

Mandatory consumer protections and other non-waivable rights remain available where required by law.
